WHAT IS IT?

The owner’s declaration is a legal document on the basis of which the ownership right to units (residential or non-residential) is registered in the Land Registry.

When is it needed?

An owner’s declaration is required if the immovable property (typically a residential or family house or the land of which such a house is a part) is to be divided into individual units. On the basis of the owner’s declaration, for example, the existing members of the housing cooperative can acquire “their” flats, which they only rent from the cooperative, into so-called “personal ownership”, become their full owners and possibly sell them more advantageously.

Sometimes it is necessary to change the existing owner’s declaration, e.g. when one of the owners of the units in the building decides to reconstruct his/her apartment and thus change its floor plan or area.
